Terms and Conditions

Article 1 – Purpose

The purpose of these General Terms and Conditions of Sale (hereinafter "GTC") is to define the conditions under which Shooldy (hereinafter "the Seller") sells, via its website www.shooldy.com (hereinafter "the Website"), ergonomic products, in particular a shoulder cushion, as well as any products or accessories that may be added to its catalog at a later date.

The GTC govern all contractual relations between the Seller and any natural person acting as a consumer or non-professional (hereinafter "the Customer") wishing to make a purchase on the Site.

Any order placed on the Website implies full, complete, and unconditional acceptance of these Terms and Conditions.

Article 3 – Products

3.2. The photographs, illustrations, and visuals appearing on the Website are for informational purposes only and do not engage the Seller's responsibility.

3.3. The Seller reserves the right to modify the range of products offered for sale at any time.

Article 4 – Price

4.1. Prices are quoted in euros (€).
For deliveries within the European Union, the United States, Canada, and the United Kingdom, prices are displayed inclusive of all taxes (TTC).

4.2. Customs duties, import taxes, or additional fees may be charged by the authorities of the destination country. These fees, which are independent of the Seller, are the sole responsibility of the Customer.

4.3. The Seller reserves the right to modify its prices at any time. The applicable price is the price in effect at the time the order is confirmed.

Article 5 – Ordering

5.1. The Customer places an order by following the steps indicated on the Website.
The order is only considered final after confirmation by email.

5.2. The Seller reserves the right to refuse or cancel any order in the event of:

  • existing dispute with the Customer,
  • total or partial non-payment of a previous order,
  • suspicion of fraud or misuse of the Site.

5.3. The Customer guarantees the accuracy of the information provided when placing the order. The Seller shall not be held liable for any errors attributable to the Customer.

Article 6 – Payment

6.1. Payment is due immediately upon placing the order.
It is made using the secure payment methods offered on the Website.

6.2. Payments are processed by a service provider that complies with applicable security standards. The Seller never has access to the Customer's bank details.

Article 7 – Delivery

7.1. Delivery areas

The Seller provides delivery to the following areas:

  • mainland France

  • Canada

7.2. Delivery charges

Shipping costs vary depending on:

  • the destination country,
  • the selected carrier,
  • the weight and volume of the package.

They are indicated at the time of ordering.

7.3. Delivery times

Delivery times are provided for informational purposes only.
The Seller cannot be held responsible for delays attributable to the carrier, customs services, or any external events.

7.4. Customs and taxes

For deliveries outside the EU, customs duties or local taxes may apply.
These charges are the responsibility of the Customer, who is solely responsible for their payment.

Article 8 – Right of withdrawal

8.1. Statutory time limit

In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has a period of 14 days from receipt of the product to exercise their right of withdrawal.

8.2. Terms and conditions of exercise

The Customer must notify the Seller of their decision to withdraw by email or via the contact form on the Website.

8.3. Returning the product

The product must be returned:

  • in its original condition,
  • clean, unused,
  • in its original packaging if possible.

Return shipping costs are the responsibility of the Customer, in accordance with the law.

8.4. Refund

The Seller will issue a refund within 14 days of receiving the returned product or proof of shipment provided by the Customer.
The refund covers the price of the product and the initial standard delivery costs.

Article 9 – Legal warranties

The products sold benefit from:

  • of the legal guarantee of conformity (Articles L217-3 to L217-20 of the Consumer Code),
  • the warranty against hidden defects (Articles 1641 to 1649 of the Civil Code).

In the event of a defect, the Customer must contact the Seller providing a detailed description of the problem and, if possible, photographs.

Article 10 – Liability

10.1. The Seller shall not be held liable in the event of misuse of the product by the Customer.

10.2. The Seller shall not be held liable for delays or failures in delivery attributable to the carrier, customs services, or force majeure.

10.3. The Seller shall not be liable for any indirect damage.

Article 11 – Intellectual Property

All elements present on the Website (text, images, logos, videos, the Shooldy brand, etc.) are protected by intellectual property laws.
Any unauthorized reproduction, representation, or use is strictly prohibited.

Article 12 – Personal data

The personal data collected is processed in accordance with applicable regulations and the privacy policy available on the Website.

The Customer has the right to access, rectify, oppose, and delete their data.

Article 13 – Applicable law and dispute resolution

These Terms and Conditions are subject to French law.

In the event of a dispute, the parties shall endeavor to seek an amicable solution.
Failing this, the French courts shall have sole jurisdiction.

Article 14 – Modification of the GTC

The Seller reserves the right to modify these Terms and Conditions at any time.
The applicable Terms and Conditions are those in effect on the date of the order.
